"Border Wall: 9th Circuit Tosses Appeal From Greens, Calif."

"Federal judges have again rejected a legal challenge from California and conservation groups opposed to border wall construction along the southern border.

The 9th U.S. Circuit Court of Appeals today tossed arguments that the Trump administration overstepped when the Department of Homeland Security fast-tracked barrier projects near San Diego and Calexico, Calif., and waived certain environmental laws for construction.

A three-judge panel found it lacked jurisdiction over some of the challengers' claims but could review some others.

Ultimately, though, the court sided with the government and found that the border projects — wall prototypes and new fencing — were within DHS's authority under the Illegal Immigration Reform and Immigrant Responsibility Act of 1996."
